Terms of Service

1. Acceptance

By creating a Blem Dating account or using the service in any way, you agree to these Terms and our Privacy Policy. If you don't agree, don't use Blem Dating.

2. Eligibility

You must be at least 18 years old and able to form a legally binding contract. By signing up you confirm both. We may suspend accounts that turn out to be under 18.

3. Subscription & billing

• Blem Dating costs $19/month, billed monthly through Stripe. Price may change with 30 days notice.
• Your subscription auto-renews each month until you cancel.
• You can cancel anytime from Settings → Billing → Manage subscription. Access continues through the end of the current billing period.
• We don't issue refunds for partial months. If something serious goes wrong (e.g., the service is broken for a meaningful period), email us and we'll work it out case-by-case.

4. Identity & consent for uploaded photos

You may only upload photos of yourself. Blem Dating uses identity-conditioned image generation (the new generation of "face swap" tools) which produces highly convincing synthetic images of whoever is in your uploaded selfie. That power comes with hard rules:

• You will not upload a photo of any other person — including ex-partners, family, coworkers, friends, public figures, or anyone else — without their explicit, documented consent.
• Doing so may violate state law on non-consensual intimate imagery and deepfakes (California AB 602 and SB 926, Texas SB 751, Virginia § 18.2-386.2, New York § 52-c, and similar statutes elsewhere) as well as federal proposals like the NO FAKES Act if enacted.
• By uploading a selfie you affirm under our Terms that the person in the photo is you, you have the legal right to upload it, and you consent to Blem Dating processing it for AI image generation.
• We may suspend or terminate accounts that we have reason to believe are uploading other people's photos, and report serious cases to law enforcement.
• You indemnify Blem Dating and Healthcare Financial Consortium, Inc. against any claims arising from photos you upload in violation of this section.

5. Acceptable use

You won't:

• Upload someone else's photo and pretend it's you, or face-swap to impersonate anyone.
• Use Blem Dating to harass, threaten, or send abusive messages.
• Use Blem Dating against minors or anyone who hasn't consented to be contacted.
• Reverse-engineer, scrape, or automate the service.
• Resell Blem Dating outputs as a separate paid service.
• Use the service for anything illegal in your jurisdiction.

We reserve the right to suspend or terminate accounts that violate these rules. Serious violations get reported to law enforcement.

6. Your content

You own the photos, messages, and other content you submit. You grant Blem Dating a limited license to process them for the sole purpose of providing the service (e.g., sending your selfie to Gemini to generate a swap, sending pasted DMs to Claude to draft a reply). We don't claim ownership and we don't train our own models on your content.

7. AI output disclaimer

Replies, scores, date ideas, and generated images come from AI models that make mistakes. They are suggestions, not advice. Don't rely on them for legal, medical, financial, or safety-critical decisions. You're responsible for what you send, post, or do.

Generated images may contain artifacts and should be treated as inspiration / styling references rather than literal photos to post as if real. Don't use them in ways that mislead people about who you are.

8. Intellectual property

The Blem Dating brand, software, templates, and design are owned by Healthcare Financial Consortium, Inc. You may not copy or redistribute them.

9. Termination

You can delete your account anytime by emailing hi@datemax.app. We can terminate accounts for violations of these Terms, fraud, or abuse, with or without notice.

10. Disclaimers

Blem Dating is provided "as is" without warranty of any kind. We don't guarantee you'll get more dates, more replies, or any specific result. Dating outcomes depend on you.

11. Limitation of liability

To the maximum extent allowed by law, our total liability for any claim is limited to the amount you paid us in the prior 12 months. We are not liable for indirect, incidental, or consequential damages.

12. Governing law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of laws. Disputes go to a court in California, or to arbitration if both sides agree.

13. Changes

We may update these Terms. If we change something material, we'll email registered users at least 14 days before the change takes effect. Continued use after that means you accept the new Terms.
